PREMIUM SUBSCRIBER AGREEMENT / TERMS AND CONDITIONS

If you have registered an FARAD Premium Subscription (SaaS) account, use the FARAD CONNECT web site and you use the FARAD  Apps and available products, benefits and tools offered by the FARAD  software,  you absolutely and unequivocally agree to acknowledge and be bound by the following terms  ('Terms').

FARAD CONNECT Subscription Terms

You must be 13 years and older to use this site.

You are responsible for any activity that occurs under your user subscription account name.

You are responsible for keeping your password, PIN Code and Personal Security Code secure and safe.

You must not spam mail, abuse, harass, threaten, impersonate, hack or intimidate other FARAD CONNECT subscribers.
You must not use the benefits available to you as a subscriber to cross sell, cross promote and or otherwise entice existing subscriber to another network in a manner considered unethical of without the consent of the subscriber receiving cross selling or promotion information. If you do these things, your subscription may be de-activated or terminated.

You may not use the FARAD CONNECT services for any illegal or unauthorized purposes. All subscribers around the world agree to comply with all local laws regarding conduct and acceptable behavior.

You understand that FARAD CONNECT is an Enterprise Software and Information Technology Network.

You understand that the FARAD CONNECT is defined as Software as a Service (SaaS), a software licensing and delivery model in which software is licensed on a subscription basis and is centrally hosted. It is sometimes referred to as "on-demand" software. SaaS is typically accessed by users using a web browser or mobile device.  SaaS has become a common delivery model for many business applications, including office and messaging software, payroll processing software, DBMS software, management software, CAD software, development software, gamification, virtualization, account, collaboration, customer relationship management (CRM), management information systems (MIS), enterprise resource planning (ERP), invoicing, human resource management (HRM), talent acquisition, content management (CM) and others.

You understand and acknowledge that The FARAD CONNECT is not a broker

You understand and acknowledge that The FARAD CONNECT is not a bank

You understand and ackowledge that the FARAD CONNECT is not a money services business

You understand and acknowledge that The FARAD CONNECT is not a barter exchange

You understand and acknowledge that The FARAD CONNECT is not a multi level marketing (MLM), direct sales or affiliate organization

You understand and acknowledge that FARAD Premium Subscription is offered as Software as a Service (SAAS) and requires a monthly subscription payment. In return the subscriber receives certain benefits and a non-exclusive license to utlize the software available to Premium Subscribers. We (and our licensors) remain the sole owner of all right, title, and interest in the Services and Software. We reserve all rights not granted under these terms.

To become a Connect Premium subscriber, a user pays a one-time $5.95 activation fee and first month subscription of $5.95. Each consecutive month thereafter the Premium subscriber will be automatically billed $5.95

BY ACTIVATING AN FARAD PREMIUM ACCOUNT, FARAD PREMIUM SUBSCRIBERS CONSENT TO HAVING THEIR MONTHLY SUBSCRIPTION CONNECT FEE OF $5.95 AUTOMATICALLY WITHDRAWN FROM THE METHOD OF PAYMENT THEY SELECTED AT ACTIVATION.
SHOULD A PREMIUM SUBSCRIBER NO LONGER WISH TO PAY FOR MONTHLY SUBSCRIPTION, THEY CAN EITHER DE-ACTIVATE OR CANCEL THEIR USER ACCOUNT. THIS FEATURE IS AVAILABLE IN THE PROFILE SECTION OF A SUBSCRIBERS ACCOUNT.

From time to time Connect Premium subscribers may receive a notification polling them if they are still satisfied with their billing schedule. Connect Premium subscribers can cancel their subscription at any time and for any reason.
Annual Connect Premium subscribers will automatically have their subscription renewed at the end of the calendar year subscription unless they personally cancel their subscription and account through the subscription cancellation function in their account menu.

Connect Premium subscription has to remain active during the subscription program chosen by the FARAD subscriber to continue to receive Connect Premium subscription rebates ( if offered ), including but not limited to FARAD Booking, ADVT Credits / Discounts and FARAD  Participation Rebates. If Connect Premium subscription is not paid because of a lack of funds on behalf of the FARAD subscriber, membership will convert to free FARAD LITE subscription until such time that the subscriber pays $5.95 at which time the Connect Premium subscription will be re-activated. 

REFUND AND CHARGE BACK / DISPUTE POLICY

By activating and paying the product subscription activation fee, a new subscriber agrees and accepts to be bound by the FARAD Network Refund and Charge Back / Dispute Policy.

FARAD will provide an unconditional refund of product purchase activation fees ($5.95) within 15 calendar days of the initial purchase. This will enable new customers to take full advantage of the entire product suite for 15 full days while making up their minds whether they like and want to continue their product subscription membership. At the end of the 15th day, customers agree to not chargeback or dispute the product activation fee and waive their rights to a full refund.

FARAD will provide an unconditional refund of the monthly customer product subscription fee of $5.95 within 10 calendar days of the occurance of such payment. Customers effectively can enjoy 10 days of full services and benefits, while still being able to request and claim a full refund of the monthly subscription fee covering the subscription period in question. At the end of the 10th day, customers agree to not chargeback or dispute the subscription payment and waive their right to a full refund.

FARAD will provide an unconditional refund of ADVT purchases within 3 calendar days of the purchase date. At the end of the 3rd calendar day, customers agree to not charge back or dispute the ADVT purchase transaction and waive their right to a full refund.

You understand that we will only access, view, or listen to your content in limited ways. For example, in order to perform the Services, we may need to access, view, or listen to your content to (a) respond to support requests; (b) detect, prevent, or otherwise address fraud, security , unlawful, or technical issues; and (c) enforce these terms. Our automated systems may analyze your content using techniques such as machine learning. This analysis might occur as the content is sent, received, or when it is stored. From this analysis, we are able to improve the subscribed Services.

You understand that you can not make traditional deposits in United States Dollars or any other legally denominated and accepted currency into your connect wallet account.  Funds paid in a user's wallet account are the result of conditional incentive rebates made by FARAD CONNECT to its subscribers.  Third party funds cannot be deposited in a user's wallet account.  FARAD CONNECT is not a third party money transmitter. The wallet purchase advt function is utilized for the purposes of Premium subscription, farad or expo payments whereas the prospective Connect Premium subscriber does not have access to or ability to pay for their Premium subscription with a debit or credit card. FARAD CONNECT does not charge for or otherwise financially benefit from this feature. No commissions or fees are applied except those charged by the processor of the credit or debit card transaction, normally 3.9% plus $0.30 per transaction. Purchase ADVT credits transactions are considered purchases and not deposits.

The FARAD Premium subscriber wallet Connect Withdraw Funds feature is exclusively established for the withdrawal of FARAD  Participation rebates. It is prohibited to utilize this function for the purposes of third party money transmission. Subscribers cannot fund their connect wallet account for purposes of withdrawing those funds outside the scope of what the function was established for. To illustrate, a subscriber cannot use the PURCHASE ADVT CREDITS function to deposit funds in their wallet account for the purpose of then withdrawing those funds to another source as their sole intention outside of the stated purpose of the function.

When you use the function of PURCHASE ADVT CREDITS you are, in fact, purchasing advanced credits to be used as funds in the following manner:

As an option to use the wallet to pay for your Connect Premium subscription.
Purchase content in  FARAD Expo and or purchase Farads

The following example is how this great benefit and function cannot be used and any FARAD subscriber who willfully and intentionally uses the ADVT function for the purposes of any external source funding as an exclusive application is subject to review and possible subscription de-activation and subscription termination action.

EXAMPLE: Credit your connect wallet account with funds paid for with a debit or credit card, then immediately withdraw those funds to an external source without using them for their intended purposes.  

The Withdraw Funds function is intended specifically for the purposes of

Withdrawing FARAD  Participation Rebates extended to Connect Premium subscribers from time to time,
Discount Rebates paid to FARAD subscribers Advertising in FARAD Expo
Funds received as a consequence of the sale of FARAD farad value products.

You understand that the FARAD CONNECT is not a retail merchant.  FARAD CONNECT has partnered with third party networks to faciliate out-of-network transactions and does not act as an atribitrator in those transactions nor does it charge a fee or commission for such transactions. The results of transactions in the FARAD CONNECT are not based on a reliance on the entrepreneurial or managerial efforts of FARAD CONNECT staff.

You understand and acknowledge that only the information posted on this website is accurate and up-to-date regarding information and explanations referencing the FARAD CONNECT. While you may encounter, experience, hear, view or receive promotional presentations relating to FARAD and the FARAD CONNECT, it cannot be verified that this information is accurate, correct or even endorsed by the FARAD CONNECT. Therefor, the only true and correct source of information regarding FARAD and the FARAD CONNECT is to be found on the official website of the FARAD CONNECT at https://www.faradconnect.net

You shall be completely and solely responsible for your own content, product, service or store submissions and the consequences of posing or publishing them. In connection with the content submissions, you affirm, represent, and/or warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize FARAD CONNECT to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all user content submissions to enable inclusion and use of the submissions in the manner contemplated by the website and these terms and conditions.

Don't respond to emails asking for your account or personal financial information. Spoof and phishing (pronounced "fishing") are terms coined to describe emails made to look like they've come from legitimate sources and companies but that actually come from identity thieves. These emails warn you of account problems or other urgent issues to trick you into clicking through to a scam website. The scam website then asks you to enter your user name and password or other account information. Once you do this, you've given your information to someone who might use it to do you harm. The FARAD CONNECT will NEVER ask you to enter your password or any other personal information, including but not limited to financial information, in an email or send such information in an email. You should only share information about your account once you have logged into the website directly from your browser.

In connection with the user content submissions, you agree that you will not submit material, including video and photography, that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post and submit the material and to grant FARAD CONNECT all of the license rights granted herein.

Unauthorized subscriber registration by proxy is not condoned unless expressed permission has been granted by the registrant to the registrar either verbally or in writing.  FARAD CONNECT accepts no liability for unauthorized registration by proxy and will, at the request of the registrant, either a) remove registrant data or b) provide the necessary guidance to registrant to delete their account. 

You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, photography and video clips, links ('Content')that you submit, post, and display on the FARAD CONNECT.

You must not modify, adapt or hack the FARAD CONNECT or modify another website so as to falsely imply that it is associated with the FARAD CONNECT.

You must not create or submit unwanted or unsollicited email to any FARAD CONNECT subscriber ('Spam').

URL and EMAIL Rotators

URL and Email Rotators are browser and software programs which direct visitors to other websites often used for cross promotion and cross selling. Rotators are often used by affiliate marketing and multi level marketing groups to direct and "blast" traffic. FARAD is not an affiliate network, direct sales network or multi level marketing network and therefore FARAD subscribers cannot use URL or Email Rotators to spam messages to other FARAD subscribers and doing so is a direct violation of the FARAD subscriber Spam Policy and subscribers who do so are subject to account termination.  Rotator messages are considered "unwanted" and "unsollicited" communications and are not to be used within the FARAD network.

You understand that each subscriber of the FARAD CONNECT can change, cancel or update their Connect Premium subscription at any time and for any reason.

You understand that FARAD Premium subscription offers SaaS software based products and services for a small monthly subscription fee. Premium subscriptions can be cancelled at any time for any reason. Premium subscription is offered as Software as a Service (Saas)

You must not transmit any worms or viruses or any code of a destructive nature.

You must not, in the use of the FARAD CONNECT, violate any laws in your jurisdiction (including but not limited to copyright laws).

Those who access or use the FARAD CONNECT website from any international jurisdictions do so at their own volition and are responsible for compliance with local law.

Violation of any of these terms will result in the termination of your FARAD CONNECT account. While FARAD CONNECT prohibits such conduct and content on its site, you understand and agree that the FARAD CONNECT cannot be responsible for the content posted on its web site and, despite our best efforts, may be exposed to such materials and that you use the FARAD CONNECT service at your own risk.  

You understand and acknowledge that the FARAD Sentinel is a highly advanced content evaluator built for the specific purposes of filtering out content that might be harmful to FARAD CONNECT users.

You understand and acknowledge that the feature of Reporting Offensive Content is an adjunct function to the FARAD Sentinel and it allows you to report any offensive postings on the FARAD CONNECT that are in violation with the good and ethical conduct of the market.

Unethical behavior

Unethical behavior or behavior deemed inappropriate in the FARAD CONNECT by an existing subscriber will not be tolerated. All published acts or behavior described in the Sentinel section of this website are cause for immediate de-activation and/or termination of subscription at the sole discretion of FARAD CONNECT without prior or given notice to the subscriber. Modifying or adapting the FARAD CONNECT for the purposes of causing existing members to be enticed for the benefit of other non FARAD CONNECT related opportunities through malicious or misleading comments is cause for immediate de-activation and/or termination of subscription at the sole discretion of FARAD CONNECT without prior or given notice to the subscriber.

FARAD CONNECT Network Communications, Messaging, Notifications and Newsletters

The FARAD CONNECT actively communicates updates, newsletters, App notifications and FARAD Mail to its subscribers. These announcements and messages are meant to be informative and share information FARAD believes might be of interest to all FARAD subscribers. FARAD CONNECT accepts no responsibility or liability, perceived or otherwise,  for messages or any kind of communication that has not been read or has been deleted by any subscriber.

Communications Decency Act

The FARAD CONNECT and its individual communications properties shall never be treated as the publisher or speaker of any information provided by an FARAD Member. The FARAD CONNECT and its individual communications properties claim this protection under 47 U.S.C. 230 which, amongst other things, protect online intermediaries like the FARAD CONNECT.

General Conditions

We reserve the right to modify the FARAD CONNECT for any reason, without notice at any time.

We reserve the right to alter these Terms at any time. If the alterations constitute a material change to the Terms, we will notify you via an appropriate method. What constitutes a 'material change' is at our discretion

By selecting a free user FARAD CONNECT LITE account on the FARAD CONNECT you agree to receive email messages from FARAD from time to time when announcements pertinent to the user base of the network are made. 

License; Representation and Warranties
As a member you represent and warrant to us that you have valid legal title to all Products and Services listed under your username in the FARAD CONNECT. The sale, promotion, distribution and re-sale of Product and Services will not violate any contract by which you are bound or any applicable law or regulation.

Indemnification
You agree to indemnify, defend and hold harmless FARAD CONNECT, its affiliated companies, and their respective officers, directors, employees, and agents against any claim, loss, damage, judgment, settlement, cost, expense, or other liability ( including, without limitation, attorney's fees ) arising from or related to (a) Products listed and sold by you (b) Services listed and sold by you (c) Products and Services sold at your store or place of business as represented in your store listing on the FARAD CONNECT (d) Your alleged breach of any representations or warranty contained in these terms and conditions (e) Any content you provide ( collectively, "Claims"). You will use counsel reasonably satisfactory to us to defend each Claim. If at any time we reasonably determine that any Claim might adversely affect us, we may take control of the defense at your reasonable expense and without affecting your indemnification and hold harmless obligations. You may not consent to the entry of any judgment or enter into any settlement without our prior written consent, which we will not unreasonably withhold.

Publicity
You may not issue any press release or make any public statement related to FARAD CONNECT, or use the name, trademarks or logo in any way ( including in promotional material ) of FARAD CONNECT or any of its affiliates without our advance written permission, or misrepresent or embellish the relationship between us in any way.

By subscribing to an account on the FARAD CONNECT you agree, understand and acknowledge all the stipulations of these terms as they are specified and described above.

We reserve the right to refuse service to anyone for any reason at any time.
